Terms of service
Affinity Search Partners makes this website available on the conditions below. Each is given as a term followed by what it means for you. Read them before going further.
- Agreement
-
Using this website means accepting these terms, and the privacy policy alongside them. The site belongs to Affinity Search Partners, 5123 Virginia Way, Suite A23, Brentwood, TN 37027. Anyone who would rather not accept them should close the page rather than continue.
- The site
-
What the site does is describe our recruiting work: finding contractors, contract-to-hire candidates, permanent hires and technology leaders for employers who need IT and information systems people. It makes no offer. Reading it creates neither a client relationship nor an obligation on either side.
Work for a client rests on a signed written agreement with that client. Whenever the site and such an agreement say different things, the agreement wins.
- Email from us
-
Emails from Affinity Search Partners may reach professionals whose roles connect with what we do, at the addresses they use for work. A reply, in any wording, halts them. The privacy policy explains the information involved and the ways to ask us to stop.
- Sample material
-
Where the site, or a sample document it links to, shows a board, a chart, a checklist or a figure, that is sample material made to illustrate a shape or an idea. No client, candidate or actual search sits behind it, and no outcome is promised by it.
- Acceptable use
-
Use the site lawfully and without getting in the way of others who use it. Specifically, do not:
- overload or disrupt it, or the systems behind it;
- try to reach any part of the site, its hosting or a connected system that was not deliberately opened to the public;
- probe or scan it for weaknesses, or test its security, unless we have agreed in writing;
- copy its content in bulk with scripts, crawlers or other automated tools;
- pretend to be someone else, or misstate your connection to any person or organisation, while using it.
- Ownership of content
-
Text, design, logos and everything else on the site belong either to Affinity Search Partners or to those who license material to us, and copyright and trademark law protect them. Viewing the site and printing pages for your own business reference is fine; reproducing, distributing or reusing anything beyond that needs our written consent.
Whatever we produce while working for a client, and who owns it, is settled by the written agreement with that client and not here.
- Third parties
-
From this site you can reach our main website and our company page on a professional networking service, and the typeface is fetched from a font service. Each belongs to someone else, runs on its own terms and privacy practices, and is not under our control. Linking to a service is not an endorsement of it, and what you encounter or agree to there is between you and them.
- Disclaimer
-
The site comes "as is" and "as available". As far as the law lets us, every warranty is disclaimed, whether express or implied, including warranties that the site is accurate, fit for a particular purpose, merchantable or free of infringement. Errors and interruptions may occur, and we give no promise otherwise.
What the site says is general information about our services and no more. It is not advice, and it is not professional, legal, financial or employment advice in particular. Hiring, engaging or employing anyone is your decision, made on your own judgement and with your own advisers where appropriate.
- Liability
-
As far as the law lets us, Affinity Search Partners, together with its owners, employees and contractors, is not liable for damages that are punitive, consequential, special, incidental or indirect, nor for lost profits, lost revenue, lost data, lost goodwill or lost business opportunities, whatever the cause and whatever the legal theory, when they arise from the site or from reliance on it.
Across every claim connected with the site, taken together, the most we can be liable for is one hundred US dollars in total. Where a jurisdiction refuses a particular limitation, that limitation applies as far as the jurisdiction allows.
- Indemnity
-
Misusing the site, or breaking these terms, makes you responsible for the consequences: you agree to defend Affinity Search Partners and its owners, employees and contractors against, and to compensate them for, any claim, loss, liability, damage or expense that results, reasonable attorneys' fees included.
- Governing law
-
State of Tennessee law governs these terms and every dispute connected with them or with the site, and its conflict-of-law rules are set aside.
- Disputes
-
A dispute we cannot settle informally goes to arbitration, binding on both sides, seated in Williamson County, Tennessee, and run under the American Arbitration Association's rules as they stand at the time. The award is final and enforceable as a judgement in any competent court. Where the law does not allow a particular dispute to be arbitrated, this term does not apply to it; and neither side loses the ability to ask a court for an injunction or other urgent relief.
- General
-
Should a court find any term invalid or unenforceable, the others carry on unaffected. Letting a breach pass on one occasion does not waive our right to act on a later one. These terms, with the privacy policy, are the whole agreement between you and Affinity Search Partners on the subject of this site, and replace anything earlier on that subject.
We may revise the terms. A revision applies from the moment it is posted, the date at the head of the page shows which version is in force, and continuing to use the site afterwards is acceptance of the revised terms.
- Contact
-
Questions about these terms go by post to Affinity Search Partners, 5123 Virginia Way, Suite A23, Brentwood, TN 37027, or through the form on our contact page.
